Noted sells creative, artistic and lifestyle products, including notebooks and accessories.

Many of our products are produced using print-on-demand manufacturing.

Product colours, appearance and dimensions may vary slightly from images displayed online because of:

• screen settings;
• lighting;
• manufacturing processes;
• printing processes; and
• product batches.

We aim to display product information as accurately as reasonably possible.

3. Product Availability

Products are subject to availability.

We reserve the right to discontinue, modify or update products, designs, descriptions and pricing.

If an order cannot reasonably be fulfilled after purchase, we will contact the customer and provide an appropriate resolution in accordance with applicable law.

4. Prices

Product prices are displayed on the relevant product pages and/or checkout.

Shipping is charged separately unless expressly stated otherwise.

Taxes, duties, customs charges or other fees may apply depending on the customer’s location.

5. Orders

When you place an order, you are making an offer to purchase the selected products.

An order confirmation does not necessarily mean that Noted has accepted the order if there is a legitimate reason preventing fulfillment.

We reserve the right to cancel an order where reasonably necessary, including in cases involving:

• suspected fraud;
• significant pricing errors;
• technical errors;
• product unavailability; or
• inability to fulfill the order.

Where an order is cancelled after payment, the applicable refund will be processed.

6. Payment

Payment must be completed through the payment methods offered at checkout.

Customers are responsible for providing accurate billing and payment information.

7. Order Cancellations

Customers may request cancellation within 24 hours, provided production has not already begun.

Once production begins, cancellation may no longer be possible except where required by applicable law.

8. Shipping

Shipping costs are separate from product prices unless expressly stated otherwise.

Delivery estimates are not guaranteed dates unless expressly stated.

9. Returns and Refunds

Returns and refunds are governed by our Refund & Return Policy.

Nothing in these Terms removes mandatory consumer rights applicable to your purchase.

10. Intellectual Property

All original Noted designs, artwork, graphics, logos, photographs, product imagery, written content, branding and other original materials are owned by Noted or used by Noted with appropriate permission/licensing.

You may not, without written permission:

• copy Noted designs;
• reproduce Noted artwork;
• modify and redistribute Noted artwork;
• sell Noted designs as your own;
• use Noted designs commercially;
• reproduce Noted artwork on other products;
• remove Noted branding from materials where applicable;
• use Noted product photography commercially; or
• claim Noted’s creative work as your own.

Purchasing a physical Noted product does not transfer intellectual-property rights in the artwork or design to the customer.

11. Customer Content and Reviews

If you submit a review, photograph, comment or other content to Noted, you must ensure that you have the right to submit that content.

You must not submit content that:

• is fraudulent or deliberately misleading;
• infringes another person’s intellectual-property rights;
• contains unlawful material;
• harasses or threatens another person;
• contains hateful or abusive content;
• contains personal information that you do not have permission to share; or
• is intended to damage Noted through false claims.

We reserve the right to moderate or remove content where reasonably necessary and where permitted by law.

12. Prohibited Use

You may not use the Noted website or products for unlawful, fraudulent, abusive or malicious purposes.

You may not attempt to interfere with the operation or security of our website.

13. Third-Party Services

Noted uses third-party services, including Shopify and services such as Printify, to operate the store and fulfill orders.

Third-party services may have their own terms and privacy policies.

14. Privacy

Our collection and use of customer information is described in our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time.

The version published on this website will be the current version.

Changes will not remove rights that cannot legally be removed.

16. Applicable Law

These Terms are intended to operate consistently with applicable South African law and any mandatory consumer-protection laws that apply to customers in their jurisdiction.

Nothing in these Terms prevents a consumer from exercising mandatory rights available under applicable law.
